Welcome to Rootz! These Terms and Conditions (“Terms”) govern your use of the Rootz app and services, provided by LinkOrigin Technology Limited UK (“we”, “us”, or “our”). By accessing or using Rootz, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

 1. Acceptance of Terms
By creating an account or using our services, you agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines we provide.

 2. Eligibility
You must be at least 13 years old to use Rootz. By using Rootz, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use our services.

 3. Account Registration

 3.1 Account Creation
To access certain features of Rootz, you must create an account by providing accurate and complete information. You agree to update your information as necessary to keep it accurate and complete.

 3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

 4. Use of Services

 4.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use Rootz in accordance with these Terms. This license is for personal use only.

 4.2 Prohibited Activities
You agree not to:
– Use Rootz for any illegal or unauthorized purpose.
– Post or share any content that is harmful, abusive, threatening, defamatory, obscene, or otherwise objectionable.
– Violate any laws, regulations, or third-party rights.
– Interfere with or disrupt the operation of Rootz or its servers.
– Attempt to gain unauthorized access to any part of Rootz or its systems.
– Use any automated means to access Rootz, including bots, spiders, or scrapers.
– Impersonate any person or entity or misrepresent your affiliation with any person or entity.
– Harass, intimidate, defame, threaten, or engage in any hateful conduct.
– Share content that exploits or abuses children, promotes suicide or self-harm, or is sexually explicit.

 5. User Content

 5.1 Content Ownership
You retain ownership of any content you post or share on Rootz (“User Content”). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, modify, and distribute your content in connection with the operation of Rootz.

 5.2 Content Responsibility
You are solely responsible for your User Content and any consequences of posting or sharing it. We do not endorse any User Content and are not responsible for any damages or losses resulting from it.

 5.3 Content Moderation
We reserve the right, but are not obligated, to review, remove, or modify any User Content that violates these Terms or our policies. Content that harasses, intimidates, defames, threatens, or includes hateful conduct, child sexual exploitation, promotion of suicide or self-harm, or sexually explicit material will be removed and may result in account suspension.

 6. Data Protection and Privacy

Our Privacy Policy describes what information you share with us, when it is shared, and how we handle it when you use our services. By using our services, you understand and consent that we must collect, use, store, process, share, and transfer this information to countries where we operate our services and to partners who help us provide our services.

 7. Reporting Violative Content

We are not under an obligation to monitor the content people share through our services. Nevertheless, we want Rootz to be a place where people can have fun and express themselves while feeling safe. Content that violates another person’s rights, or does not comply with laws, rules, regulations, or these Terms (“Violative Content”) is prohibited. If you see Violative Content, you can report it to us through the reporting feature in the app or by visiting our website.

If you believe your content has been copied in a way that infringes your intellectual property rights, you can report this directly in the app or by visiting our intellectual property reporting form on our website.

 8. Ending Our Services

We may temporarily or permanently suspend your account and prevent your use of our services if we determine that you have shared Violative Content or used our services in a way that violates another person’s rights, or does not comply with laws, rules, regulations, or these Terms.

We operate a three-strike policy in most instances. That means if you share violative content, we will suspend your account for 30 days, during which you will not be able to share content or see other content on our services. If this happens three times, you will be permanently suspended from our services and prevented from creating a new Rootz account.

Certain Violative Content (e.g., child sexual abuse material) will result in immediate and permanent suspension. You may appeal a suspension by contacting us through our support form.

To protect users and our services, we may temporarily suspend your account if we detect abnormal activity that could present technical or security risks.

We will delete your account if it is inactive for more than two years. Before doing so, we will notify you to give you a chance to stop the deletion.

You can delete your account at any time by going into the settings and choosing the account deletion option.

 9. License to Use Our Services

Our services are protected by copyright, trademark, trade secret, and other laws around the world. Nothing in these Terms gives you the right to use the Rootz name or any of the Rootz trademarks, logos, domain names, or other distinctive brand features.

During your use of our services, we grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided as part of our services. This license is solely to enable you to use and enjoy our services in a manner consistent with these Terms. This license ends when you stop using our services.

Rootz is free to use any feedback, comments, or suggestions you provide regarding our services.

 10. Limitation of Liability

To the fullest extent permitted by law, LinkOrigin Technology Limited UK, its affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising from or related to your use of or inability to use Rootz.

 11. Indemnification

You agree to indemnify, defend, and hold harmless LinkOrigin Technology Limited UK, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of Rootz, your User Content, your violation of these Terms, or your violation of any rights of another.

 12. Governing Law and Dispute Resolution

 12.1 Governing Law
These Terms and any disputes arising out of or related to them will be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

 12.2 Dispute Resolution
Any disputes arising out of or related to these Terms or Rootz will be resolved through binding arbitration conducted by the Chartered Institute of Arbitrators in the UK. You and LinkOrigin Technology Limited UK agree to submit to the jurisdiction of the courts in the UK for any actions not subject to arbitration.

 13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any material changes by posting the new Terms on Rootz and updating the “Last Updated” date. Your continued use of Rootz after the changes take effect constitutes your acceptance of the revised Terms.

 14. General

If any part of these Terms is found to be unenforceable, all other provisions will remain in full force and effect. These Terms constitute the entire agreement between you and LinkOrigin Technology Limited UK regarding your use of Rootz.
